2. Cap on Liability

Our total aggregate liability to you for all claims arising from or related to these Terms and Conditions or your use of our services shall not exceed the total amount you paid to InsightCore in the twelve months preceding the event giving rise to the liability, or €100, whichever is greater.

We shall not be liable for any failure or delay in performing our obligations under these Terms and Conditions due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, internet service provider failures, power outages, or other force majeure events.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by applicable law. These limitations apply whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis.

These Terms and Conditions shall be governed by and construed in accordance with the substantive laws of Finland, without giving effect to any principles of conflicts of law. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.

2. Jurisdiction and Venue

You agree that any legal action or proceeding arising from these Terms and Conditions shall be brought exclusively in the competent courts of Helsinki, Finland. You hereby consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

Before initiating any legal proceedings, the parties agree to attempt resolution through the following process:

1. Informal Negotiation: Contact us to discuss the issue and seek an amicable resolution (30 days)
2. Mediation: If informal negotiation fails, participate in good-faith mediation with a neutral third party (60 days)
3. Arbitration or Litigation: If mediation is unsuccessful, proceed to binding arbitration or court proceedings as appropriate

4. Class Action Waiver

To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in class actions against InsightCore.

Nothing in these Terms and Conditions shall affect your statutory rights as a consumer under Finnish consumer protection law or EU consumer protection directives. If any provision of these Terms conflicts with mandatory consumer protection laws, the law shall prevail.

Provisions that by their nature should survive termination of these Terms and Conditions shall survive, including but not limited to: indemnification obligations, limitation of liability, intellectual property rights, dispute resolution provisions, and general provisions.

6. Language

These Terms and Conditions are provided in English. Any translations provided for convenience are not legally binding. In case of any discrepancy between the English version and any translation, the English version shall prevail.
